Terms & Conditions

1. Additional Costs:

    1.1 Any additional costs incurred during the cleaning process due to unforeseen circumstances or at the Client’s request shall be mutually agreed upon by both parties in writing before proceeding with the additional services.

2. Non-Disclosure:
   2.1 Both parties agree to keep all information and details related to this Contract and the services provided confidential and shall not disclose such information to any third parties without prior written consent.

3. Client’s Obligations:
   3.1 The Client shall ensure that the solar panels are accessible to the Service Provider on the scheduled cleaning dates.
   3.2 The Client shall provide all necessary information and access to the premises required for the Service Provider to perform the cleaning services effectively and safely.

4. Limitation of Liability:
   4.1 The Service Provider shall not be held liable for any damage to the solar panels or any other property of the Client arising from factors beyond their control.
   4.2 The Service Provider shall not be responsible for any decrease in the performance of the solar panels due to factors unrelated to the cleaning services provided.
   4.3 The Service Provider shall not be held responsible for any pre-existing damage or defects in the solar panels.
   4.4 The Service Provider shall carry liability insurance to cover any damage caused to the solar panels or the Client’s property during the cleaning process.

5. Estimated Savings
    5.1 All savings mentioned are estimations and can vary based on location, panel type, angle of roof, weather, shade.

6. Termination:
   6.1 Either Party may terminate this Contract by providing a written notice to the other Party at least 30 days in advance.
   6.2 Termination of the Contract shall not relieve the Client from their obligation to pay for the services rendered prior to the termination date.
   6.3 Customer is responsible to pay the cancel fee from above, or discount received on the initial service, if customer terminates the contract before all services agreed upon are rendered.

7. Governing Law and Jurisdiction:
   7.1 This Contract shall be governed by and construed in accordance with the laws of California/USA.
   7.2 Any disputes arising out of or in connection with this Contract shall be subject to the exclusive jurisdiction of the courts of California/USA.

8. Entire Agreement:
   8.1 This Contract constitutes the entire agreement between the Parties and supersedes all prior agreements, understandings, and communications, whether written or oral, relating to the subject matter herein.

9. Warrantee
   9.1 All bird proofing jobs will have a 3 year warrantee on hooks and mesh.
   9.2 If damage outside of natural causes (such as rodents/weather) warrantee will be voided. 
   9.3 If by chance it rains within 3 days after a cleaning service was rendered, Customer will be able to contact office to schedule a free re-service.

10. Consent to Capture Media
   10.1 By availing of our technician services, you grant permission for our technicians to capture photographs and videos of the work carried out and products installed on your premises, including your house and property.
   10.2 Intended Use of Media: The media captured by our technicians may be used for documentation, quality assurance, training purposes, or promotional materials related to our services. We commit to using these materials responsibly and in compliance with applicable laws and regulations.
   10.3 **Privacy and Confidentiality**: We prioritize your privacy and ensure that any media captured will not disclose sensitive information or compromise your confidentiality. Our technicians are trained to respect boundaries and focus solely on the task at hand.
   10.4 **Customer Rights**: You reserve the right to request that certain areas or aspects of the work not be photographed or recorded. Please communicate any concerns or preferences regarding media capture to our technicians beforehand.
   10.5 **Ownership and Usage Rights**: While you consent to the capture of media, you retain ownership rights to your property and any identifiable aspects within the media. We acquire usage rights solely for the purposes outlined in this agreement.
   10.6 **Opt-Out Option**: If you prefer not to have any media captured during the service visit, please inform our technicians, and we will comply with your request accordingly.
   10.7 **Discretion and Professionalism**: Our technicians are trained to exercise discretion and professionalism when capturing media on your premises. They will strive to minimize disruption and ensure a positive experience throughout the service visit.
   10.8 **Liability**: We shall not be liable for any damages, losses, or claims arising from the capture or use of media, except in cases of willful misconduct or gross negligence on our part.

11. Services
   11.1 Solar panel cleaning includes the cleaning of the tops of the panels with purified water and brush.
   11.2 Window cleaning includes the cleaning of the frames, sills, and glass of the window. Also includes cleaning of the screens unless they were previously damaged.
   11.3 Gutter cleaning includes the scooping of the gutters around the whole home and a flush with water to make sure the downspouts work correctly. If they do not drain we will use a snake to attempt to clear debris. If issue is under ground it is not included in service.
   11.4 Bird proofing includes the cleaning of under the panels to clear debris as much as possible without having to remove panels and void warranty. It also includes a mesh installation around the panels to keep small to medium size rodents from entering under the panels.
